1. Acceptance of Terms

Welcome to Bald Filter - Haircut AI Changer. These Terms and Conditions ("Terms") govern your access to and use of the Bald Filter - Haircut AI Changer mobile application, website, and related services (collectively, the "Service"). The Service is provided by Bald Filter - Haircut AI Changer ("we," "us," or "our").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. If you are under 18, you must have permission from a parent or legal guardian to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Use License

3.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Bald Filter - Haircut AI Changer app on a device you own or control
  • Access and use the Service for your personal, non-commercial use
  • Access features and content available through your subscription level

3.2 License Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Remove, alter, or obscure any proprietary notices
  • Use the Service for any commercial purpose without our written consent
  • License, sell, rent, lease, transfer, or distribute the Service
  • Use the Service in any way that violates applicable laws or regulations
  • Use automated systems (bots, scrapers) to access the Service
  • Attempt to gain unauthorized access to any part of the Service

4. User Account

4.1 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to:

  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4.2 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm the Service or other users.

5. Prohibited Uses

You agree not to use the Service to:

  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Violate any local, state, national, or international law
  • Infringe upon the intellectual property rights of others
  • Upload photos of individuals without their consent
  • Create or distribute deepfakes or misleading content intended to deceive
  • Harass, abuse, or harm another person or group
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Introduce viruses, malware, or other malicious code
  • Collect or harvest personal information of other users
  • Use the Service for any illegal or unauthorized purpose
  • Engage in any activity that could damage our reputation or business

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of any photos, images, or other content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and display Your Content solely for the purpose of providing and improving the Service.

You represent and warrant that:

  • You own or have the necessary rights to Your Content
  • Your Content does not violate any third-party rights
  • Your Content complies with these Terms and applicable laws
  • You have obtained necessary consents from individuals depicted in Your Content

6.2 Our Content

The Service, including its original content, features, functionality, software, designs, graphics, and trademarks, is owned by Bald Filter - Haircut AI Changer and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not use our trademarks, logos, or branding without our prior written consent.

6.3 Generated Content

Images generated by our AI transformation features ("Generated Content") are provided to you for personal use. You may download, save, and share Generated Content, but you may not use it for commercial purposes without appropriate rights to the underlying photo.

7. Premium Subscription Terms

7.1 Subscription Plans

Bald Filter - Haircut AI Changer offers premium subscription plans that provide access to additional features, including:

  • Access to all filters and transformations
  • HD quality image processing
  • Ad-free experience
  • Unlimited transformations
  • Priority processing

7.2 Billing and Payment

  • Subscriptions are billed through the App Store (iOS) or Google Play Store (Android)
  • Prices are displayed in your local currency and may include applicable taxes
  • You authorize us to charge your payment method for the subscription fee
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Prices may change with notice, but changes won't affect your current subscription period

7.3 Free Trials

We may offer free trial periods for premium subscriptions. You must cancel before the trial ends to avoid charges. If you don't cancel, your payment method will be charged the subscription fee.

7.4 Cancellation and Refunds

  • You can cancel your subscription at any time through your app store account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial subscription periods
  • Refund requests are subject to the app store's refund policy
  • We reserve the right to refuse service to anyone for any reason

7.5 Changes to Subscription

We reserve the right to modify, suspend, or discontinue any part of the premium subscription service at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuance of the service.

8. Privacy and Data Usage

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

9. Third-Party Services and Links

The Service may contain links to third-party websites, services, or content that we do not own or control. We are not responsible for:

  • The content, privacy policies, or practices of third-party services
  • Any damage or loss caused by your use of third-party services
  • The availability or accuracy of third-party services

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or quality of the Service
  • Warranties that defects will be corrected

We do not guarantee that:

  • The Service will meet your requirements
  • AI-generated transformations will be accurate or realistic
  • Any errors in the Service will be corrected
  • The Service will be available at all times

Your use of the Service is at your sole risk. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALDIFY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damage to reputation or business
  • Cost of substitute services
  • Any damages arising from your use or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bald Filter - Haircut AI Changer and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Content uploaded to the Service
  • Any fraudulent, harmful, or illegal activity

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@baldify.app and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

13.2 Arbitration

If informal resolution is unsuccessful, any dispute arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except that:

  • You may assert claims in small claims court if they qualify
  • You or we may seek equitable relief in court for infringement of intellectual property rights

13.3 Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class action, consolidated action, or representative action. You waive your right to participate in class action lawsuits against us.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

For users in the European Economic Area, you also have the right to lodge complaints with your local data protection or consumer protection authority.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

17. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction. Any attempted assignment in violation of this section shall be void.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bald Filter - Haircut AI Changer regarding the Service and supersede all prior agreements and understandings, whether written or oral.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Providing in-app notifications or email notices

Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

20. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Harmful behavior toward other users
  • Extended periods of inactivity
  • Upon your request

Upon termination:

  • Your right to use the Service will cease immediately
  • Your account data may be deleted
  • You must cease all use of the Service
  • Provisions that should survive termination will remain in effect

22. Acknowledgment

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICE.
